New Category of “No Quota” Work Permit in Italy
New work permit in Italy : Italian government has made available the online forms for the new category of work permit introduced in Immigration law in August 2023. The application is for Non-EU workers who have already worked abroad for Italian companies or companies participated by Italian firms, and who can now obtain a work permit not subject to immigration quotas (flow decree). More specifically, workers who have been employed, for at least twelve months within the forty-eight months preceding the application, by companies headquartered in Italy or companies participated by Italian firms, can obtain a work permit to be employed at the locations of the same companies or entities in Italy.
The option is named art.27 comma 1 i bis and the relevant application form is ICT/art. 27 comma 1 lett i bis option Modulo LDE. The government has disclosed the list of documents required to file the applications.
The Italian company must provide the following documentation:
- Financial statement or consolidated financial statement
- Self-certification regarding the total duration of employment of the requested worker at the overseas office(s) (at least 12 months within 48 months prior to the application).
This documentation should be compiled and submitted as part of the application process for hiring foreign workers under the provisions of Article 27, paragraph 1, letter i-bis of the Italian Immigration law.
