The Constitutional Court has decided to join the Campobasso and Mantua cases concerning Italian citizenship by descent.
The three proceedings (two from Campobasso and one from Mantua) will now be examined together in a single hearing scheduled for June 9, 2026, at 9:30 a.m. in Rome.”
The cases focus on Article 3-bis of Law No. 91/1992 (as amended by Law No. 74/2025), which introduced restrictions on the recognition of citizenship jure sanguinis.
The Campobasso court raised concerns that the provision may effectively remove a right acquired at birth and could conflict with constitutional and EU principles, including equal treatment.
The cases to be heard in June, now joined, have a broader scope compared to the constitutional issue raised by the Turin court, as they challenge the constitutionality of the new law as a whole, including procedural aspects such as the urgency of the decree.
As a final, but no less important point, it is relevant to note that the decision related to the Turin hearing held last 11th March has not yet been published; further comments will follow once it becomes available.
