Work Permits in Italy: The Annual Quota System

Non-EU nationals must obtain a work permit (Nulla Osta) to legally work in Italy. Work permits in Italy generally fall under an annual quota system established by the Italian government through the Decreto Flussi. This decree sets the maximum number of permits for various worker categories. It also defines the specific period during which applications may be submitted. Permits are usually issued on a first-come, first-served basis.

However, some categories of work permits are exempt from the quota system. These include the EU Blue Card, the Intra-Company Transfer (ICT) permit, and the Service Agreement. The authorities may issue such permits at any time of the year, regardless of the annual limits.

EU Blue Card: A Non-Quota Work Permit for Highly Qualified Workers

The EU Blue Card is a non-quota work permit available year-round for highly skilled workers. It is not subject to the annual immigration quotas, making it a flexible option for specialized professionals.

Who is Eligible for EU Blue Card Work Permit?

The EU Blue Card is available to non-EU nationals who meet the following criteria:

  1. Education or Professional Experience: Applicants must hold a higher education qualification (university or equivalent) of at least three years, or, if applicable, professional qualifications for regulated professions. The Italian Consulate in the country of issuance must validate the degrees (Dichiarazione di Valore). Alternatively, applicants may demonstrate at least five years of relevant work experience (or three years in the IT sector).
  2. Employment Offer: The applicant shall have a valid employment contract, or a binding job offer from an Italian-based employer for a highly qualified position, lasting at least 6 months.
  3. Minimum Salary: The annual salary offered must meet or exceed both the level set by national collective labour agreements and the average gross annual salary published by ISTAT (approximately €35,500).

EU Blue Card Application Procedure

While procedures may vary slightly depending on the category, the general process is as follows:

  • Work permit (Nulla Osta) Online application: The Italian employer submits an online application to the local Immigration Office (Sportello Unico per l’Immigrazione), following a labour market test and a compliance attestation (asseverazione).
  • Work Visa (Visto) application: Once the Nulla Osta is issued, the Italian Consulate in the applicant’s country of residence issues the work visa.
  • Entry into Italy: Upon arrival in Italy, the worker must report to the Immigration Office within 8 days to sign the contract of stay (contratto di soggiorno) and submit the residence permit application.
  • EU Blue Card Residence permit: The local Police Headquarters will issue the EU Blue Card residence permit, valid for 2 years (for open-ended contracts) or for the duration of the fixed-term contract plus 3 months.
