Who is Eligible for a Family Permit in Italy?

Applying for Family permit in Italy: In the case of Family Members of Non-EU Citizens

Under the Italian Immigration law:

  • foreign nationals legally residing in Italy since at least 2 years (with the exception of individuals holding residence permits for international protection) (family reunification procedure)

or

  • holders of a one-year entry visa for subordinate work or for self-employment, or for study or religious purposes or holders of 2 years investor visa (accompanying family members procedure)

have the right to have family members joining.

Main eligibility requirements include:

  • availability of adequate housing and proof that the financial/maintenance requirement is met.
  • provide documented proof of relationship to the person with a regular immigration status in Italy.

Eligible family members:

  • spouse, regularly married and of full legal age (at least 18);
  • children under 18 (also spouse’s children provided the other parent consent is granted);
  • children over 18, only if financially dependent due to total disability
  • financially dependent parents, provided they do not have any other children in their country of origin or
  • parents over 65 if they do not have any other children who can financially support them in their home country because of serious health reasons.

Entry for family reunification is allowed also to parent of a minor child who is already legally residing in Italy with the other parent, provided that the applicant can demonstrate adequate housing and sufficient income.

Applying for Family permit in Italy: In the case of Family members of an EU national residing in Italy

Under the EU principle of freedom of movement and establishment, EU citizens have the right to enter and reside freely in Italy. However, the applicable procedures vary depending on the intended length of stay—that is, whether it is for less or more than three months. In addition, similar provisions apply to family members who accompany or join the EU citizen. Specifically, family members of an EU national residing in Italy are entitled to obtain an Italian long-term residence permit (Carta di Soggiorno per familiare di cittadino comunitario).

The following family members are eligible to apply:

  1. spouse;
  2. a partner who has entered into a registered partnership with an EU/EEA citizen, under the legislation of a Member State, where the legislation of the host Member State treats registered partnerships as equivalent to marriage and in accordance with the conditions laid down by the relevant legislation of the host Member State.
  3. children under 21 years of age or financially dependent children, including those of the partner or spouse;
  4. parents if financially dependent, including those of the partner or spouse.

Rights of residence derived from a durable relationship with an EU citizen

Moreover, an application is possible also for any other family members (under certain circumstances) and for the partner with whom the EU citizen has a durable relationship, duly attested by means of official documents.
