New Italian Citizenship Law Faces Constitutional Court Review: Timeline Overview

On 17 September 2025, the Official Gazette published the order by which the Court of Turin referred a question of constitutional legitimacy concerning the new citizenship law to the Constitutional Court.

The issue concerns Article 3-bis of Law No. 74/2025, which introduces generational limits with retroactive effect and applies to individuals born abroad prior to the law coming into force. The Turin judge reiterated that the retroactive application of a law must not violate the principle of legal certainty.

In the best-case scenario, we will know the hearing date within the next few weeks. Based on the court’s calendar, this will likely take place between February and April 2026.

The ruling is usually issued one or two months after the hearing. Therefore, once we know the hearing date, we will be able to estimate the timing of the decision’s issuance.
